[bracketed] placeholder and have a qualified lawyer review it before relying on it publicly.These terms govern your use of the Performance Coaching app provided by Moritz Wegstein, Taubenstraße [Hausnummer], 60313 Frankfurt am Main, Germany ("we", "us"). By creating an account you agree to them.
1. The service
The app allows coaches to share personalised nutrition and training plans and allows coachees to log meals, workouts, and body data. Access is by invitation only. The coaching service is a Dienstvertrag (service contract) under German law — we provide expert guidance and support; we do not guarantee any specific outcome or result.
2. Eligibility & accounts
- You must be at least 18 years old.
- You are responsible for keeping your login credentials secure.
- You agree to provide accurate information.
3. Health & safety
The plans and figures in the app are general fitness guidance, not medical advice. Please read our Medical & Nutrition Disclaimer. You use the app and follow any plan at your own risk and should consult a physician where appropriate.
4. Acceptable use
- Do not misuse, disrupt, or attempt to gain unauthorised access to the service.
- Do not upload unlawful content or other people's data without their consent.
5. Coaching relationship & pricing
Coaching fees are agreed individually between you and your coach before the coaching relationship begins. All fee agreements are made directly and are separate from these terms.
6. Contract duration & cancellation
The coaching engagement has a minimum term of 3 months from the start date. After the minimum term, either party may terminate by giving 4 weeks' written notice to the end of a calendar month (4 Wochen zum Monatsende). Notice must be given by email to performancebymw@gmail.com or to your assigned coach's email address.
The right to extraordinary termination for good cause (außerordentliche Kündigung aus wichtigem Grund) remains unaffected.
7. Intellectual property
The app, its design, and its content are owned by Moritz Wegstein. Plans your coach creates for you are provided for your personal use only and may not be redistributed.
8. Liability
To the fullest extent permitted by law, our liability for indirect, consequential, or incidental loss is excluded. Our liability for outcomes of following plans is limited to intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit). Mandatory statutory liability (e.g. for personal injury) is not affected.
9. Termination of account
You may delete your account at any time via Account Settings. We may suspend or terminate accounts that materially breach these terms.
10. Governing law & jurisdiction
These terms are governed by the laws of the Federal Republic of Germany. The courts of Frankfurt am Main have non-exclusive jurisdiction, without prejudice to mandatory consumer protections applicable in your country of residence.
